In the event of a death, the situation may become difficult for the next of kin as the ownership transfer requires several processes and documents.<\/p>\n<p>In this article, Carsome will help you to understand the documents needed to transfer a vehicle\u2019s ownership to a new owner as <span style=\"color: #ff9900;\"><a style=\"color: #ff9900;\" href=\"https:\/\/www.jpj.gov.my\/en\/web\/main-site\/kenderaan1-en\/-\/knowledge_base\/vehicle\/change-of-ownership-guideline-apart-from-voluntarily\">required by the Road Transport Department (JPJ)<\/a><\/span>.<\/p>\n<p>JPJ requires seven (7) documents for the transfer. However, one set of the documents differs depending on whether the individual passed away testate (with a will) or intestate (without a will).<\/p>\n<p><strong>Testate (with a will)<\/strong><\/p>\n<p>When it comes to an individual who has passed away with a valid will, the succession (new owner) of the vehicle depends on whom the deceased has bequeathed the vehicle. The executor or executrix will need to apply to the court for a Grant of Probate, which is a court document that allows the transfer of vehicle ownership to the successor.<\/p>\n<p><strong>Intestate (without a will)<\/strong><\/p>\n<p>Should an individual passed away without leaving a valid will, the order of succession usually falls in order of: the spouse, children, parents, sibling, or the closest next of kin, as per the Distribution Act 1958 (for Non-Muslims) and Syariah Distribution (for Muslims).<\/p>\n<p>In such a situation, the administrator of the deceased assets must apply to the court for a Grant of Letter of Administration OR if the estate value is below RM2 million, a Small Estate Distribution Order according to the Small Estates (Distribution) Act 1955.<\/p>\n<p><img decoding=\"async\" loading=\"lazy\" class=\"aligncenter wp-image-16649 size-full\" src=\"https:\/\/www.carsome.my\/news\/wp-content\/uploads\/wp\/shutterstock_1024958302.jpg\" alt=\"\" width=\"1000\" height=\"665\" srcset=\"https:\/\/www.carsome.my\/news\/wp-content\/uploads\/wp\/shutterstock_1024958302.jpg 1000w, https:\/\/www.carsome.my\/news\/wp-content\/uploads\/wp\/shutterstock_1024958302-300x200.jpg 300w, https:\/\/www.carsome.my\/news\/wp-content\/uploads\/wp\/shutterstock_1024958302-768x511.jpg 768w\" sizes=\"(max-width: 1000px) 100vw, 1000px\" \/><\/p>\n<p><strong><u>Required Documents by JPJ to Effect the Transfer of Car Ownership<\/u><\/strong><\/p>\n<ul>\n<li><a href=\"https:\/\/www.jpj.gov.my\/en\/web\/main-site\/pelesenan-kenderaan-EN\"><strong><span style=\"color: #ff9900;\">JPJ K3A form<\/span><\/strong><\/a><\/li>\n<li><strong>Death Certificate<\/strong><\/li>\n<li><strong>Identification Card (MyKad) or Passport<\/strong> of the successor or administrator<\/li>\n<li><strong>Vehicle Ownership Grant or Vehicle Ownership Certificate (VOC)<\/strong><\/li>\n<li><strong>Grant of Probate <\/strong><em>OR<\/em> <strong>Grant of Letter of Administration <\/strong><em>OR<\/em> <strong>Form E or F or T from the Department of Director General of Lands and Mines <\/strong>(for those with a Small Estate Distribution Order) <em>OR<\/em> <strong>Amanah Raya Berhad<\/strong><\/li>\n<li><strong>Court Order<\/strong> (received with Grant Letter of Probate\/ Administration)<\/li>\n<li><a href=\"https:\/\/www.carsome.my\/news\/item\/what-is-a-puspakom-b5-report\"><strong><span style=\"color: #ff9900;\">Puspakom B5 Transfer of Ownership Inspection report<\/span><\/strong><\/a><\/li>\n<\/ul>\n<p><strong><u>Frequently Asked Questions<\/u><\/strong><\/p>\n<p><strong>Who can we seek help with the administration process?<\/strong><\/p>\n<p>The parties involved can decide to appoint lawyers, the Land Office and also Amanah Raya Berhad, a government agency that can help with the management of the administration process.<\/p>\n<p><strong>How long would it take to receive the court documents?<\/strong><\/p>\n<p>The administration process and receipt of documents may take up to twelve (12) months, depending on the court process.<\/p>\n<p><strong>The vehicle\u2019s owner has passed away, but I need to use the car. However, the road tax is expiring soon.
